The Student Direct Stream (SDS) is an expedited study permit processing program for those who are applying to study in Canada at a post-secondary designated learning institution (DLI). The SDS is available to legal residents who also reside in

  • Morocco

Some international students can get their study permits faster by using the SDS. IRCC processes most SDS applications within 20 calendar days if the eligibility requirements are met.

To be eligible, applicants must meet specific requirements by providing documentation upfront.

  1. proof of a valid language test result, completed within 2 years
  2. proof of a Guaranteed Investment Certificate (GIC) of CAN$10,000 or more
  3. proof of full payment of tuition for the applicant’s first year of study

Excerpts from IRCC- News Release

June 21, 2021—Ottawa—Canada’s Oath of Citizenship is more than words. It is a public declaration of belonging to our country and to our communities. That’s why the government has been hard at work over the past few years updating the Oath to include Indigenous peoples, through Bill C-8. This directly responds to the Truth and Reconciliation Commission (TRC) Call to Action 94.

The recent news of the findings in the area around the Kamloops Residential School is a stark reminder of the importance of this work and the reason why we need to continue to deliver on the TRC’s Calls to Action.

The Honourable Marco E. L. Mendicino, Minister of Immigration, Refugees and Citizenship, today announced that Bill C-8 has received Royal Assent and is now law. As of today, Canada’s Oath of Citizenship officially recognizes First Nations, Inuit and Métis, and the obligation that all citizens have to uphold the treaties between the Crown and Indigenous nations.

The new Oath of Citizenship recognizes that Indigenous rights are both enshrined in section 35 of the Constitution Act, 1982, and that they derive from the historic use of this land by Indigenous peoples. As new Canadians recite the Oath, they will make a personal commitment to observe the Aboriginal and treaty rights of First Nations, Inuit and Métis peoples.”

Canada is inviting 90,000 temporary residents who are already in Canada an opportunity to become permanent residents this year through six new immigration pathways set to launch this May.  Canada’s immigration minister, Marco Mendicino, announced the new programs on April 14, 2021.

These new Canadian immigration pathways will target essential workers, international students, and French speakers. The new programs will be for temporary workers employed in hospitals and long-term care homes, and those on the frontlines of other essential sectors, as well as international student graduates from Canadian educational institutions.

IRCC  will begin to accept applications on May 6 under the following three streams:

  • 40,000 applications for international students who graduated from a Canadian educational institution
  • 30,000 applications for temporary workers in other selected essential occupations
  • 20,000 applications for temporary workers in health care
  •  
  • This new invitation is  Canada’s initiative to help more temporary residents in Canada to remain in the country permanently which will play a vital role in Canada’s economic recovery to help the country build back better due to the Covid-19 pandemic.

Canada is aiming for 1.2 million new immigrants over the next three years.  About 401,000 are supposed to become permanent residents in 2021 alone, yet the coronavirus-related travel restrictions are still in effect, hindering some category of applicants to travel to Canada.

The honourable minister Mendicino said in a media release “These new policies will help those with a temporary status to plan their future in Canada, play a key role in our economic recovery and help us build back better,”. “Our message to them is simple: your status may be temporary, but your contributions are lasting—and we want you to stay.”

Reasons for Visa Refusal-Study Permit, Visitors Visa (All TRV)

Lack of Travel History: If a person has not travelled anywhere outside of their home country before, they will be refused a visa if they apply on their own.  Our firm can overcome this reason by making legal arguments and referencing a Federal Court Case in the application.

Strong Family Ties to Canada: having family members in Canada can be a reason for refusal, and individuals applying on their own can be refused.  Our firm can overcome this reason by making legal arguments and referencing a Federal Court Case in the application.

Canada held its latest Express Entry draw on March 18th, 2021. In this draw, candidates in the Canadian Experience Class (CEC) were invited.

A total of 5,000 invitations went to Express Entry candidates with a minimum Comprehensive Ranking System (CRS) score requirement of 449.

Mostly, IRCC holds Express Entry draws every two weeks. Canada issued invitations in every draw to a selected number of candidates who meet the CRS for the particular period. Candidates in these programs, as well as some Provincial Nominee Programs (PNPs), are given a score based on the CRS. Points are awarded depending on a candidate’s human capital factors such as age, education, work experience, and language ability in English or French.

Express Entry is Canada’s immigration application management system for three federal economic-class programs: Federal Skilled Worker Program, Federal Skilled Trades Program, and Canadian Experience Class.

CEC  is for skilled workers in Canada (many international students who qualified for PGWP) with current Canadian work experience beginning after graduation and want to become permanent residents.  One part of this group of people in this category is those who entered Canada as international students and were eligible for Post Graduate Work Permit Status after completing their education. They have worked for a minimum of one year after schooling and applied to the program by entering the pool of candidates in the Express Entry system.

Another category is persons who were employed by Canadian Employers as foreign workers. This CEC-Canadian Experience Class is 1 of the 3 federal programs managed through the Express Entry online application system for skilled workers.

Newfoundland and Labrador has created a new provincial nominee program called Priority Skills. This will provide an immigration pathway for highly skilled, highly educated individuals who have experience in priority sectors for the province.

The Priority Skills Newfoundland and Labrador immigration pathway was created in 2021 in response to growing demand from Newfoundland employers who are unable to meet the growing demand for labour in priority sectors. Andrew Furey, Premier of Newfoundland and Labrador, described the objectives of the new pathway, “This new focus in Priority Skills for immigration builds on the gathering momentum to attract and retain more newcomers with fresh ideas and perspectives for growth.”

Priority Skills Newfoundland and Labrador opened to applicants in January 2021.

Eligibility Criteria: Priority Skills Newfoundland and Labrador

Priority Skills Newfoundland and Labrador have two major categories for eligibility. Namely, candidates must have one (or more) of the following advanced academic or specialized qualifications in priority sectors such as information and communications technology, oceans technology, health care, agriculture and aquaculture:

  1. Graduates of Memorial University who have completed a Masters or Ph.D. program within the three years prior to applying.
  2. Exceptionally qualified individuals who have worked in a specialized, highly-skilled, high-demand occupation for at least one year.

The following occupations are considered eligible in-demand occupations for the stream. Note: these occupations will be revised on a regular basis to respond to Newfoundland and Labrador’s changing labour market needs.

Canada is allowing only essential travellers to enter Canada. Essential travel is defined as travel that is non-optional and non-discretionary.

The following are among the list of people allowed to travel to Canada now:

  1. 1.   Canadian citizens
  2. 2.   Permanent residents
  3. 3.   Immediate family of Canadian citizens and permanent residents (spouses, common-law partners, dependent children,           grandchildren, parent or step-parent, and guardian or tutor)
  4. 4.   Extended family members of Canadian citizens and Canadian permanent residents, (individuals in an exclusive and long-term relationship and their dependent children; non-dependent children, grandchildren, siblings, half-and step-siblings and grandparents).
  5. 5.   Permanent resident applicants who were approved for permanent residence on or before March 18, 2020.
  6. Individuals who are in possession of Confirmation of Permanent Residence (COPR) and Permanent Resident Visa (PRV) issued on or before March 18 but whose documents have now expired. Visa holders from the U.S. qualify regardless of when they received their visas.
  7. 6.  Temporary foreign workers
  8. 7.   Foreign nationals entering Canada on humanitarian and compassionate grounds in special circumstances, such as terminal illness, serious injury or death.
  9. 8.  International students who held a valid study permit or who had been approved for a study permit on or before March 18, 2020.

9 International students attending a Designated Learning Institution that has obtained prior approval of its response plan to control the spread of COVID-19 from the provincial government. (Effective October 20). The list of approved DLIs is here.

Individuals entering Canada are required by law to quarantine themselves immediately for a period of 14 days to help avoid the potential spread of COVID-19.

Anyone entering Canada will also be required to provide a negative COVID-19 test before arriving in the country. This measure does not replace the 14-day quarantine.
